Verizon wireless cell phone insurance help?

I have the total equipment coverage (I believe; its the 6.99 or 7.99 monthly one on an "advanced device") on my lg enV Touch which I have had since last September before the 9.99 monthly dxata plan was required for this cell phone. I was told by a verizon worker that if I need this phone replaced, the replacement would need this data plan. My parents said I can not get the replacement if I need this data plan because they already pay for the insurance/ plan. I offered to pay it myself but they pointed out that they are my only source of income, yet they will not let me get a job. Now my brother broke my phone (touch screen and camera are shattered) because he was mad at me for something I was unaware of and my little bro and I have to pay the $89 deductable to file the claim on my phone (split it 50/50). I noticed that through the insurance papers that the phone will be replaced with a new or "certified like new" replacement phone. The last thing I want is to be without a phone, but I would hate paying for a refurbished phone and will be very angry if the phone I get is refurbished. Are there any loopholes or any ways of pursuading verizon to give me a NEW phone without the "required" data plan??? Thanks for any help!!! P.s. my other option is purchasing a new (no contract) lg dare off of ebay to put on my current line because after the $89 insurance claim fee and $10 a month this would be cheaper and the Dare has none of the problems of the enV Touch. Thanks so much for clearing this up for me. Is there any way that you, being a vzw employee, can give me some sort of proof or your word that i can show the people at the vzw near me in case they try to give me a hard time??? because theyve already stated otherwise.   1. 1 You will not have to pay the data plan.Believe me.I work there. #2 The Like new phones are usually just as goodif not better because they'vebeen through more testing #3 The Dare is good but the EnV Touch has better features. The Dare was one of the first touch screen phones Verizon had. You will be downgrading!
